Agreement to Terms

By accessing or using the Epic Koala website at epickoala.com ("Site") or by submitting a request for services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

These Terms apply to all visitors, customers, and others who access or use the Site or services provided by Epic Koala ("we," "our," or "us").

Services

Epic Koala provides website design, hosting, domain management, and related digital services for small businesses. Our specific service offerings, including package features and pricing, are described on our Pricing page and are subject to change. Any changes to pricing or package contents will be communicated to existing customers before taking effect.

Service Agreements and Billing

Website service packages are offered under a 12 month agreement. By submitting a request and entering into a service agreement with Epic Koala, you agree to the following:

• Monthly service fees are billed in advance and are due on the same date each month.
• The 12 month agreement term begins on the date your website is launched and active.
• One-time setup or add-on fees (such as Google Maps Setup or Facebook Pixel) are billed at the time the service is initiated.
• All fees are non-refundable unless otherwise agreed in writing.

Failure to pay monthly fees may result in suspension or termination of your website and associated services, including email accounts and domain management.

Domain and Hosting

When you subscribe to an Epic Koala website plan, we register and manage your domain on your behalf. The domain is associated with your business and our hosting environment for the duration of your service agreement. At the conclusion of your agreement, you may request a domain transfer. Epic Koala is not responsible for any domain disputes arising from third-party domain registrars or conflicting ownership claims.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your business when requested.
• Respond to our requests for content, approvals, or clarifications in a timely manner.
• Ensure that all content, images, logos, and other materials you provide to us are owned by you or that you have the right to use them.
• Not use your website to publish content that is unlawful, defamatory, obscene, or that infringes on the rights of any third party.

Intellectual Property

The website design, template elements, code structure, and layout created by Epic Koala remain the intellectual property of Epic Koala. The content you provide — including your business name, logo, text, and images — remains your property. Upon completion of your service agreement and full payment, you may request a copy of your website files for your records.

You may not reproduce, resell, or distribute Epic Koala's proprietary design work without written permission.

Limitation of Liability

Epic Koala's liability to you for any claim arising from our services shall not exceed the total monthly fees you have paid in the three months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, loss of business opportunities, or data loss.

We make reasonable efforts to maintain uptime and site availability, but we do not guarantee uninterrupted service. Scheduled maintenance, server issues, or circumstances outside our control may result in temporary unavailability.

Termination

Either party may terminate the service agreement at the end of the 12 month term by providing written notice at least 30 days before the renewal date. Early termination by the client prior to the end of the agreed term may result in an early termination fee equal to the remaining monthly fees owed under the agreement.

Epic Koala reserves the right to suspend or terminate services immediately and without notice if a client violates these Terms, engages in illegal activity, or fails to pay amounts due after reasonable notice.

Modifications to the Site and Services

We reserve the right to modify or discontinue any feature of our services at any time. We will provide reasonable notice to active clients of any material changes that affect their service. Your continued use of the service after notice constitutes acceptance of the updated terms.

Third-Party Services

Some optional services (such as Google Ads integration, Facebook Pixel, or email marketing platforms) involve third-party providers. Your use of these third-party services is also subject to the terms and privacy policies of those providers. Epic Koala is not responsible for the actions, data practices, or service interruptions of third-party providers.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that your website will generate any specific level of traffic, leads, or business results.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the state where Epic Koala is registered and operating.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
